Why Should We Ensure Net Neutrality in Cyber World?

Introduction

Until a few days ago, no case of discrimination or differential charging in the service provided to different people had been reported. Hence, India’s cyberspace reflected the functioning of true democracy. One fine day suddenly came the report about telecom operators like AirTel and Vodofone charging extra fee for voice calls from their networks through some of the common communication apps like WhatsApp, Skype etc. Only these telecom operators charged for their services. All other service providers remained net neutral. What surprised people was the way the Telecom Regulatory Authority of India (TRAI) formulated certain rules. These newly minted rules are clearly aimed at helping certain telecom operators in India. If implemented in its current form, it would lead to the selective publication of content in the cyber world.

Net neutrality

There is an unwritten rule that people using cyber resources have followed to ensure equal opportunities for everyone, irrespective of origin, caste or financial status. This principle states that Internet Service Providers (ISPs) and government agencies should treat all data on the Internet equally without charging or discriminating against people based on users, sites, content, platforms, types of equipment or applications. This term was first coined by Columbia University professor Tim Wu. He formed this principle to increase the common belief that the Internet is a common carrier that unites everyone in this world.

Net neutrality issue

The whole issue of net neutrality came out of the public domain when mobile operators like AirTel and Vodofone tried to charge their subscribers who started using calling apps like WhatsApp, Skype etc. to contact people who used your internet network. To milk the existing customers, these telecom operators started charging additional charges on the calls made. As expected, there was a hue and cry from people who wanted to keep this medium free of these distortions. Everything seemed to shut down for a while. Again, the issue started to emerge when the TRAI released a formal consultation paper on the regulatory framework for over-the-top (OTT) services. Through this document, the telecommunications ombudsman tried to get suggestions from the public. Analysts on the ground have sought to highlight the ombudsman’s one-sided approach through this consultation paper. They also highlighted the confusing statements that could in future be misinterpreted by telecom operators to age ordinary citizens of the cyber world. This would eventually lead to the death of creativity and the airing of independent viewpoints in the cyber world. If telecom operators are given the power, they can selectively offer services to people, favoring whoever pays for them.

General convictions

This consultative document generated condemnations from all over the country. This time, even politicians joined hapless citizens in condemning the telecom ombudsman for coming up with such a vague and watered down regulatory framework for OTTs. They alleged that the TRAI is trying to help some telecom operators who have started charging extra cost on VOIP services provided over their network. To funnel the call data into a funnel, they even made separate data packets. This forced netizens to openly speak out against this move on social media. In addition to the fire, the TRAI chairman told the media that there was no rule in our country to deter telecom operators from charging for calling over the Internet. Instead of framing the rule to ensure net neutrality, the TRAI chairman tried to side with telecom operators like AirTel and Vodofone. This is the time for all of us to come together in unison to fight for our rights and freedoms in the cyber world.
